Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website located at glsportmanagement.ca (the "Site") and the paid membership and related services offered through it (together, the "Service"). The Service is provided by Gignac/Lajoie Sport Management ("GLSM", "we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who you are contracting with
The Service is provided by Gignac/Lajoie Sport Management, a hockey advisory business operating in Canada. You confirm that you are of the age of majority in your jurisdiction (or have the consent of a parent or guardian) and, if you are entering into these Terms on behalf of an organization, that you have authority to bind that organization.
2. The Service
The Site provides information about our advisory services, a member area (the "Client Portal"), a player-development session registration flow, and other tools we may add from time to time. Nothing on the Site constitutes a formal representation, agency, or employment agreement — those are governed by separate signed agreements.
3. Accounts and credentials
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Notify us immediately at glsportsmgmt@gmail.com if you suspect unauthorized use.
4. Acceptable use
You agree not to:
- use the Service for anything unlawful, fraudulent, or misleading;
- infringe anyone's intellectual property, privacy, or publicity rights;
- upload malware or attempt to probe, scan, or breach the security of the Service;
- scrape, harvest, or copy content or data except as expressly permitted;
- resell, redistribute, reverse engineer, or circumvent technical limits;
- impersonate another person or misrepresent your affiliation.
5. Intellectual property
The Site, the Client Portal, all software, text, graphics, logos, athlete media, and other content are owned by GLSM or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use (or for the internal business use of an organization you represent). You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
6. Payment, subscriptions, and taxes
Paid features (including the Client Portal membership and player-development session registrations) are billed at the prices shown at checkout in Canadian dollars (CAD). Membership plans renew automatically at the end of each billing period (monthly or yearly, as selected) unless cancelled before the renewal date. Applicable taxes are calculated and displayed at checkout.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Checkout Buyer Terms also apply to your purchase and govern payment, billing, tax, cancellation, and refund mechanics alongside our own Refund Policy.
7. Cancellation
You may cancel a recurring membership at any time from the Client Portal's "Manage subscription" area or by contacting us. Cancellation stops future renewals; you keep access until the end of the current billing period. Refund eligibility is described in our Refund Policy.
8. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, without notice if you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate our policies. We may also discontinue all or part of the Service at any time. On termination, your right to use the Service ends and we may delete data associated with your account after a reasonable export window.
9. Service level and disclaimers
The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses, and we make no guarantee regarding player outcomes, placements, scholarships, or contracts. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, GLSM will not be liable for any indirect, incidental, consequential, special, or exemplary damages (including loss of profits, revenue, data, or goodwill). Our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) CAD $100. Nothing in these Terms limits liability that cannot be limited under applicable law (such as fraud, or death or personal injury caused by negligence).
11. Indemnity
You will indemnify and hold harmless GLSM and its personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service in breach of these Terms, your content, or your violation of any law or third-party right.
12. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. The courts located in Ottawa, Ontario have exclusive jurisdiction over any dispute arising from or relating to these Terms, subject to any mandatory consumer-protection laws of your place of residence.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where appropriate, communicated in the Site or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
